Abstract
This work aims to examine the most recent developments in constitutional jurisprudence, regarding the relationship between the common judge, the Constitutional Court and the Court of Justice, when there is a contrast between a legal provision and a provision of the EU Charter of Fundamental Rights or of EU secondary law with direct effect, which pertains to the same rights protected also by internal parameters.
