Abstract
This paper examines the controversial speed camera vandalism, which can be subsumed under both Article 635 of the Criminal Code and Article 15 of Legislative Decree No. 285/1992. In particular, we critically analyse majority jurisprudential orientation, which focuses on the criterion of speciality in order to identify the prevailing provision. We seek to provide interpretative and normative solutions to allow for better coordination between sanctions established in different branches of the legal system.
