The Supreme Court of Cassation has overturned its former orientation, resulting from a Court order of\r\n2006, by stating that the merger dissolves the incorporated company: the comment once again examines,\r\nalbeit from a different and complementary perspective with respect to the work of Prof. Cagnasso already\r\npublished in this journal, the relationship between dissolution and continuity of legal relationships in\r\nmergers, broadening the scope of the analysis also to the issue of the opening of bankruptcy proceedings.
