Abstract

[Autom. eng. transl.] The contribution deals with the rules on which the existence of Italian jurisdiction depends in relation to a liability action brought against the Irish Administrator of a hedge-type investment fund located in the Cayman Islands for having falsified the fund's balance sheet data and thus induced some investors, recipients of this and further information in the context of a negotiation that took place in Italy with the manager of the fund management company and an intermediary, to purchase shares in the fund. In this regard, a number of questions arise concerning the interpretation of the art. 7, point 2, of the reg. (EU) no. 1215/2012, which provides for special jurisdiction in the field of civil offences: the question of the location of the event generating the damage where the offense results from conduct by different subjects in different States, and the location of the injury where the damage derives from the decision to proceed with an investment on the basis of false information.
