Abstract

[Machine translation] Right to health and health systems to the test of the pandemic. The 'lessons' of some\r\nNational Recovery and Resilience Plans – The pandemic emergency has highlighted that, in\r\ncertain contexts, science is a necessary interlocutor of politics, thus re-proposing and\r\ncatalyzing the reflection on the relationship between political decision-maker and scientific\r\nexpertise. In particular, the essay analyzes how the regulatory paradigm resulting from the\r\ninteraction of the two factors during the pandemic is configured and legitimized, both with\r\nreference to its construction and in relation to judicial review, taking into account the\r\ntheoretical perspective, as well as the impact of the evidence-based rule-making on the form\r\nof State and of government.
